Betfair Fined in Australia for Breaching Spam Laws

The Australian Communications and Media Authority (ACMA) has imposed a fine of AU$871,660 on Betfair for violating spam laws by sending promotional materials to VIP customers without proper consent.

According to ACMA, an investigation found that Betfair sent 148 promotional emails and texts to customers between March and December 2024, without their consent or after they had opted out.

Additionally, the operator sent six messages and emails during the same period that lacked an unsubscribe option for customers.

The messages in question were sent to Betfair's VIP program members, promoting offers like deposit bonuses and complimentary event tickets. They contravene Australia's spam laws, which have been in place for more than 20 years.

VIP programs are generally designed to attract and retain customers with high betting activity, however this doesn't mean VIP customers are well off or can afford losses. Sending promotional gambling messages to these customers without consent or with no option to opt-out is incredibly irresponsible in addition to being non-compliant.

Betfair Commits to Regulatory Adherence

In addition to the fine, Betfair has agreed to a two-year court-enforceable undertaking, committing to invest in independent assessments of its marketing campaigns to ensure compliance.

The bookmaker will also implement an extensive training program for staff, conduct quarterly internal audits, and provide regular updates to the ACMA on its compliance efforts.

Spam messages have lately been a key focus area for ACMA's enforcement actions. In May 2025, the authority fined PointsBet $500,000 for sending over 800 unsolicited messages to customers in 2023.

Last month, Tabcorb was also fined $4 million for sending thousands of marketing messages to customers enrolled in its VIP program.
